Terms of service

These Terms of Service apply to all users of this website and customers purchasing from Acqua Bathrooms. They should be read together with our Returns & Refund Policy, Shipping Policy and Privacy Policy.


1. Overview

This website is operated by Acqua Bathrooms (“we”, “us”, “our”).

By accessing this website or purchasing from us, you agree to be bound by these Terms.

If you do not agree, you must not use this website.

Our store is hosted on Shopify Inc., which provides the e-commerce platform used to sell our products.


2. Use of Website

You confirm that you are at least 18 years of age.

You agree not to:

  • Use the website or products for unlawful purposes

  • Breach applicable laws or regulations

  • Transmit malicious code

  • Attempt unauthorised access to our systems

We may refuse service or terminate access at our discretion.


3. Products, Pricing & Availability

All prices are in Australian Dollars (AUD) and include GST where applicable.

We reserve the right to:

  • Change prices

  • Limit quantities

  • Refuse or cancel orders

  • Discontinue products

Product images are for illustration only. Variations in colour, finish and appearance may occur.

If goods are unavailable after purchase, we may offer a comparable alternative or provide a refund.


4. Orders & Cancellations

Order Acceptance

We may cancel or refuse orders where:

  • Pricing errors occur

  • Fraud is suspected

  • Stock is unavailable

If cancelled after payment, a refund will be issued.

Cancellation Window

Orders may be cancelled within 24 hours provided processing has not commenced.

After 24 hours, cancellation may not be possible.

Non-Cancellable Items

The following cannot be cancelled once ordered:

  • Clearance / Final Sale items

  • Special order or supplier-allocated items

  • Items marked non-cancellable

Orders that have been dispatched cannot be cancelled.

5. Delivery & Risk

Delivery timeframes are estimates only.

Risk in goods passes to the customer upon delivery or collection.

Goods must be inspected immediately upon delivery.

Any damage or discrepancies must be reported within 3 days via:

Failure to report within this timeframe may result in the claim being declined.


6. Installation & Customer Responsibility

Products must be installed by licensed tradespersons where required by law.

Customers, builders and installers are responsible for verifying:

  • Measurements

  • Set-out requirements

  • Product suitability

  • Compliance with regulations

  • Compatibility with site conditions

We are not liable for:

  • Labour costs

  • Removal or reinstallation costs

  • Project delays

  • Incorrect installation

  • Misuse or improper handling

Installed items are not eligible for return unless a manufacturing fault is confirmed.


7. Returns & Claims

All returns and claims must be submitted through:

Unauthorised returns will be refused.

Change-of-mind returns are subject to our Returns & Refund Policy.

Supplier assessment for faults may take up to 14 business days.


8. Warranty

Warranty coverage is subject to manufacturer terms.

Warranty covers product replacement or parts only.

Warranty does not cover:

  • Labour costs

  • Installation or removal costs

  • Transport costs unless approved

  • Damage caused by misuse, incorrect installation or lack of maintenance

Nothing in these Terms excludes your rights under Australian Consumer Law.


9. Trade Accounts

Trade account holders must comply with these Terms and any separate agreement.

We may suspend or terminate trade accounts, revoke pricing, or cancel bulk orders at our discretion.

Trade account holders are responsible for all orders placed under their account.


10. Bundle & Promotional Offers

If part of a bundle or promotional offer is returned, discounts applied to remaining items may be adjusted accordingly.

We do not provide retrospective discounts or price adjustments.


11. Fraud Prevention & Chargebacks

We reserve the right to verify any order prior to dispatch.

This may include identity verification or additional documentation.

If a chargeback or payment dispute is initiated after delivery, we reserve the right to provide proof of delivery and recover associated losses where permitted by law.

Fraudulent transactions may result in cancellation of current and future orders.


12. Storage of Goods & Uncollected Orders

Orders approved for collection must be collected within 7 calendar days of notification unless otherwise agreed.

If goods remain uncollected, we may:

  • Charge reasonable storage fees;

  • Cancel the order and apply restocking fees;

  • Return goods to stock.

Bulky goods may attract additional storage charges.


13. Failed Delivery & Refused Goods

If delivery fails due to:

  • No person present;

  • Unsafe or inaccessible site;

  • Customer refusal without approved cancellation;

we may charge re-delivery fees and associated return freight costs.

Returned goods due to refusal will be treated as a change-of-mind return.


14. Retention of Title

Ownership of goods remains with Acqua Bathrooms until full payment has been received and cleared.

We reserve the right to recover goods where payment has not been made.

Risk passes to the customer upon delivery.


15. Intellectual Property

All website content including images, branding, logos and product descriptions is the property of Acqua Bathrooms.

Unauthorised reproduction or commercial use is prohibited.

We reserve the right to take legal action for intellectual property infringement.


16. Third-Party Services

We may use third-party providers including payment gateways and financing services.

Their terms apply separately and we are not responsible for third-party policies.


17. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential loss.

  • Liability for goods supplied is limited to replacement or refund in accordance with Australian Consumer Law.


18. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including freight disruptions, supplier delays, natural disasters, government restrictions or industrial action.


19. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Disputes are subject to the jurisdiction of NSW courts.


20. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.
